One month of detention for Ikballe Huduti
The Special Department of the Basic Court in Pristina has acted upon request of the Special Prosecution Office of the Republic of Kosovo to impose detention against the defendant Ikballe Huduti, for encouraging the terrorist offense, as defined by Article 134 of the Criminal Code of Kosovo.
“The court has rendered a ruling for sentencing the defendant Ikballe Huduti to one (1) month in detention.
The court have analyzed all the reasons for the detention order and approved the prosecutor’s motion for detention. The Court considers that the legal conditions are met as provided by Article 187 par. 1 subpar.1.1, Article 187 par. 1 under par. 1.1 of 1.2 point 1.2.1, Article 187 paragraph 1 sub paragraph 1.1 and 1.2 point 1.2.2 and Article 187 paragraph 1 subpar. 1.1 of 1.2 item 1.2.3
There is a well-founded suspicion that the defendant, Ikballe Huduti, has committed the alleged criminal offense, which is proved by her post on Facebook social network encouraging terrorist offenses. The Court also considers that there is a well-grounded fear that if the defendant is released she may try to avoid criminal responsibility she face, which could then obstruct normal course of the procedure,” the press release emphasizes.
Mrs Huduti has the right to appeal this decision to the Court of Appeal.
Otherwise, Ikballe Huduti Berisha was arrested by Kosovo Police after she called for revenge on the US, in her post on Facebook, following the killing of Iranian General, Qasem Soleimani, by the US military forces.
