Thaçi-Kurti meeting and the constitutional deadlines for forming the government
President Thaci sent three invitations letters for a meeting to the leader of Vetevendosje, Albin Kurti, but all these invitations were rejected by the latter. Main subject of these consultative meeting was the mandate for formation of the government.
Following two first invitations, sent by the president in one day, he then decided to meet Kurti today at 10:00, but Kurti has meanwhile offered to meet him on Monday next year, January 6th.
Concerning deadlines for prime ministerial mandate, expert on constitutional matters, Mazllum Baraliu, have told KosovaPress that the Article 95 of the Constitution provides that, as soon as Mr. Kurti is mandated for the prime minister by the president, begins the 15-days deadline for formation of the government.
If there are no votes for that, then a 10-days deadline applies, and if still there’s no votes president announces new elections which must be held within 40 days.
Yet, as Baraliu specifies the Article 85 underlines that the mandated prime minister has 60 days to from the new government, starting from the day he is appointed by the president to conclude this issue. If unsuccessful, then president announces new elections.
In addition to these two articles, which doesn’t allow any second party to run for the prime minister, there is ruling of the Constitutional Court from 2014, that allows the second or the third party to nominate their own prime minister candidate, following the failure of the first party to do so.
